Terms of Service
These Terms govern your access to and use of Checkup. By creating an account, accepting an order form or using the services, you agree to these Terms.

1. Agreement and eligibility
These Terms form an agreement between DEV IT LLC (“DEV IT,” “Checkup,” “we,” “us” or “our”) and the person or organization using the Checkup website, workspace, Agent, mobile application or related services (the “Service”). If you do not agree, do not use the Service.
If you use Checkup for an organization, you represent that you have authority to bind it. To create an account, you must:
- Be at least 18 years old and legally able to enter into contracts.
- Complete the applicable registration process and provide accurate, current information.
- Comply with applicable laws, export controls and sanctions.
- Not be prohibited or restricted from using United States services.
2. The Checkup Service
Checkup provides tools for supported mobile device information, guided diagnostics, grading, available IMEI-related checks, supported erasure workflows, stations, workspaces and processing history. Features, supported devices, limits and availability depend on the selected plan, configuration, region and current product documentation.
We may update, add, limit or discontinue features. We will provide notice when required by an applicable agreement or law. Enterprise order forms, statements of work or other signed terms control if they expressly conflict with these Terms.
3. Accounts and security
You are responsible for your account, authorized users, credentials, devices and all activity under your control. Keep credentials confidential, grant only appropriate access and notify us promptly of suspected unauthorized access.
You must maintain accurate account and billing information. DEV IT LLC may rely on the account owner and designated administrators for instructions concerning the workspace and its users.
4. Plans, billing and taxes
Checkup may offer Free, Premium and Enterprise plans. Current self-service prices and included limits are shown on the website or at checkout; Enterprise terms may be set out in an order form. Paid subscriptions renew for the period shown at purchase until cancelled.
Unless an order form or applicable law states otherwise:
- Self-service payments are processed through Stripe and are subject to the payment provider’s terms.
- Fees are charged in the displayed billing currency and exclude applicable taxes.
- Fees are non-refundable except when DEV IT LLC ends a prepaid Service without cause or when a refund is required by law.
- We may change future fees by providing notice through the website, account or email; changes apply no earlier than the next applicable renewal.
5. Customer Data
You retain ownership of information, records, content and instructions submitted to Checkup (“Customer Data”). You grant DEV IT LLC and its service providers a limited right to host, copy, transmit, process and display Customer Data only as necessary to provide, secure and support the Service, comply with law and enforce these Terms.
You are responsible for having all rights, notices, permissions and lawful bases required to submit Customer Data, connect devices and instruct Checkup to perform checks or other processing. You must not submit information or devices that you are not authorized to process.
6. Acceptable use
You must not, and must not help another person to:
- Use Checkup unlawfully, fraudulently or to violate intellectual property, privacy, consumer protection or other rights.
- Access, diagnose, erase or obtain information from a device without appropriate authorization.
- Introduce malware, interfere with the Service, bypass limits or security controls, or probe systems without written permission.
- Reverse engineer, decompile or attempt to derive non-public source code except where the law expressly permits it.
- Scrape, mine, resell or use automated means to extract the Service or its data without written authorization.
- Share credentials, impersonate another person or misrepresent diagnostic results.
- Use results or external checks as the sole basis for an unlawful, discriminatory or deceptive decision.
7. Device checks and results
Checkup results reflect the supported tests, device responses and third-party information available when a check is performed. A result is not a warranty, certification or guarantee of a device’s condition, ownership, future performance, value or legal status.
You remain responsible for reviewing results, following device-manufacturer and legal requirements, preserving necessary backups and deciding whether a device may be processed, purchased, sold, repaired, erased or otherwise handled.
8. Intellectual property and feedback
DEV IT LLC and its licensors own Checkup, including its software, design, documentation, trademarks and other intellectual property. These Terms give you a limited, non-exclusive, non-transferable right to use the Service during the agreement for your internal business purposes.
If you provide suggestions or feedback, you grant DEV IT LLC a worldwide, perpetual, irrevocable, royalty-free right to use it without restriction or compensation, provided we do not identify you publicly without permission.
9. Third-party services
Checkup may depend on or link to third-party services, including payment, hosting, communications and device-information providers. Their services may be subject to separate terms and privacy practices.
DEV IT LLC is not responsible for a third party’s independent acts, omissions or availability. This does not limit responsibilities that cannot legally be excluded or our obligations concerning service providers acting on our behalf.
10. Privacy and data protection
Our Privacy Policy and Cookie Policy explain how DEV IT LLC handles Personal Information. If DEV IT LLC processes Personal Information on behalf of a business customer, an applicable data processing addendum or signed agreement may provide additional terms.
Each party will comply with the data protection laws applicable to its role. Customers are responsible for responding to individuals and giving legally required notices concerning Customer Data they control.
11. Changes, suspension and termination
We may update these Terms by posting a revised version and changing the effective date. Material changes will receive additional notice when required. Continued use after the effective date constitutes acceptance to the extent permitted by law.
You may stop using Checkup and cancel as provided in your account or agreement. We may suspend or terminate access for material breach, non-payment, security risk, unlawful use or to comply with law. Where practical, we will provide notice and an opportunity to cure.
After termination, access ends and Customer Data may be deleted subject to the Privacy Policy, an applicable data processing addendum, backup cycles and legal retention requirements. Accrued payment obligations and provisions intended to survive termination remain effective.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHECKUP IS PROVIDED “AS IS” AND “AS AVAILABLE.” DEV IT LLC DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND ANY WARRANTY ARISING FROM COURSE OF DEALING.
We do not guarantee uninterrupted or error-free operation, that every device or test is supported, or that any diagnostic or external result will be complete, current or suitable for a particular business decision. Nothing in these Terms excludes a warranty or right that cannot legally be excluded.
13. Liability and indemnity
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEV IT LLC AND ITS TEAM WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS INTERRUPTION, EVEN IF ADVISED THAT SUCH DAMAGE MAY OCCUR.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEV IT LLC’S TOTAL LIABILITY ARISING FROM THE SERVICE OR THESE TERMS WILL NOT EXCEED THE FEES YOU PAID FOR THE AFFECTED SERVICE DURING THE ONE MONTH IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limits do not apply where prohibited by law.
You will defend and indemnify DEV IT LLC and its personnel against third-party claims, losses and reasonable legal costs arising from Customer Data, devices you process, your unlawful or unauthorized use of Checkup, or your breach of these Terms, except to the extent caused by DEV IT LLC.
14. General terms and contact
Virginia law governs these Terms without regard to conflict-of-law rules. Unless applicable law requires otherwise, state and federal courts located in Fairfax County, Virginia have exclusive jurisdiction over disputes.
Neither party is liable for delay caused by events beyond its reasonable control. You may not assign these Terms without our written consent; DEV IT LLC may assign them in connection with a merger, reorganization, sale or by operation of law.
If a provision is unenforceable, it will be limited as necessary and the remaining provisions continue. Failure to enforce a provision is not a waiver. These Terms and incorporated agreements are the entire agreement regarding the Service. Translations are provided for convenience; the English version controls to the extent permitted by law.
